Consultations on Vietnamese Property Law
In December 2020, Prof. Rösler resumed his advisory work on the reform of Vietnamese civil law as part of the German-Vietnamese Rule of Law Dialogue. He had previously advised the Vietnamese government office on the reform of the law of obligations on several occasions (Civil Code of 2015; see the reports from 2014 and 2015). Currently, the focus is on modernizing the law of property and, in particular, the law governing credit security (Decree 163/2006/ND-CP and Decree No. 11/2012/ND-CP).
His written statement and presentation focused in particular on the securing of movable and immovable property as well as claims. Key issues included the principles of specificity and speciality, as well as the requirement for a specific type of security. The question of the essential components of a parcel of land or a building was also discussed in depth. Together with attorney Dr. Jan Valentin Deichsel, the German legal expert at the German Society for International Cooperation (GIZ), the consultations will continue in 2021.
