Termination of Employment

If the employment relationship is to end before the expiration of the regular notice period or on a date within a quarter or a month, a termination agreement may be entered into as of any date of the parties’ choosing.

Unlike a unilateral termination, the termination of the employment relationship through a termination agreement requires the employer’s consent.

A request to enter into a dissolution agreement may be filed by the following persons: 

  • Technical and Administrative Staff 
  • Research staff 
  • Student and research assistants (SHK/WHB) 

Please submit the request in a timely manner through official channels to the Human Resources Department. 

After consultation with the Staff Council, the Human Resources Department will prepare the termination agreement and send it to you for signature. 

From the time the termination request is received by the Human Resources Department, it takes approximately three weeks to process the request and prepare the contract for your signature.

Information for Civil Servants (Termination of Civil Service)

A civil servant may be dismissed from civil service if he or she submits a written request to that effect. A request submitted electronically is not sufficient.

Unlike termination under labor law, which can be initiated unilaterally, dismissal from civil service is only effective upon a decision by the employer.

Important points regarding dismissal:

  • Dismissal generally takes effect on the date requested. 
  • The employer may postpone the dismissal by up to three months to ensure that official duties are properly carried out. 
  • A request for dismissal may be withdrawn within two weeks of its receipt by the superior authority. After that, withdrawal is only possible with the consent of the superior authority. 
  • If a civil servant transfers to another employer, the termination occurs automatically by operation of law (“automatic transfer”); a separate order is not required in this case.
